Broadway Pilates Terms & Conditions and Refund Policy

These terms and conditions include general terms and conditions for use of this Site,
terms and conditions relating to the services provided by Broadway Pilates
on the site and in our studio.

 

Please read these terms and conditions carefully. Your use of the site, the purchase of any
Products or Services on this site or in a studio will be subject to these terms and conditions.


 

Terms & Conditions

Classes are always subject to availability but we will always do our best to accommodate

you in your chosen class.

All classes must be prepaid and all clients agree to our 24hr notice policy when cancelling

and/or rescheduling. If you’re booked into a class, but miss it or cancel with less than 24 hours’ notice,

you will be charged for it.

 

Out of consideration for the Trainer and other Clients, and also for your own safety (the warm-up

is an important aspect of each class) please be aware that if you are more than 5 minutes late for a class,

you may be refused to participate.

 

Classes and Personal training sessions are valid for 3 months from the date of purchase,

unless stated otherwise.

 

Important Liability Statement

The information available on or through this site, and the Services supplied via or in connection with
this site do not constitute medical advice and it is your responsibility to determine, through obtaining appropriate medical advice, that you are fit and well and that such contents and services
are suitable for you.

It is not our responsibility to do so. Before commencing any exercise regime, you should consult your doctor.
It is also vital that you supply us with correct information about yourself. We cannot be liable for any incorrect information supplied by you to us. We try to make sure that all information contained on this site (and provided by us to you as part of any Services or Products) is correct, but, subject to the paragraph below, we do not accept any liability for any error or omission and exclude all liability for any action you (your legal representatives, heirs) may take or loss or injury you may suffer (direct or indirect including loss of pay, profit, opportunity or time, pain and suffering, any indirect, consequential or special loss, however arising) as a result of relying on any information on this site or provided through any Service supplied by us to you.

You, your legal representatives and your heirs release, waive, discharge and covenant,
not to sue Broadway Pilates and its instructors for any injury or death caused by
their negligence or other acts.

Statutory Rights and Refunds and Cancellation

Classes are sold in blocks of 1, 3, 6, 8, 10, and 20 or such other combinations as Broadway Pilates
may introduce. Blocks of classes may be shared by arrangement. Class fees are non refundable.


Class fees may be increased by Broadway Pilates at any time. The Proprietor shall give Clients
not less than 14 days notice prior to any such increases.

 

The rights of cancellation and refund and any limitation expressed in these terms and conditions
do not affect your statutory rights as a consumer. Refunds in relation to Products or Services may only
be credited to the credit or debit card originally used to make the purchase.
An administration fee of £50.00 is applicable.

 

Your Personal Information

 

Usage of your personal information is governed by the Broadway Pilates privacy policy,
which forms part of these Terms and Conditions.

Data Protection

Broadway Pilates as a Data Controller. In the course of its daily organisational activities, Broadway Pilates acquires, processes and store personal data in relation to:
● Clients of Broadway Pilates
● Third Party service providers to Broadway Pilates

 

Broadway Pilates regularly exchanges with Third Party services in order to provide booking
systems and other CRM services.

Broadway Pilates complies with the Data Protection Principles Rights. This applies to all
Personal Data collected, processed and stored by Broadway Pilates in relation to its services and activities.
All personal data will be treated carefully and managed for the services and activities
Broadway Pilates provides and its third party providers that help run the business.

 

The Data Protection key principles are enriched in the UK legislation and EU Regulation and are
fundamental to Broadway Pilates Data Protection Policy.

Broadway Pilates as a data controller will ensure and abide that all data will be fairly obtained.
Will be used for 1 or more specific and legitimate purposes. Not be further processed in
a manner incompatible with the specific purposes. To be kept safe and secure. To be kept accurate,
complete and up to date where necessary. Broadway Pilates will be adequate, relevant and
not excessive in relations to the purpose(s) for which the data were collected and processed
and not to be kept longer than necessary to satisfy the specific purpose(s). And to be managed
and stored in such a manner that, in the event a data subject submits a valid
Subject Access Request seeking a copy of their personal data,
this can be readily provided to them.

 

Liability

You are referred to the important liability statement at the top of these terms and conditions. Subject to that statement you agree that your use of this Site and the Service is on an “as is” and “as available” basis. On that basis, except as expressly set out in these terms, Broadway Pilates does not enter into conditions, warranties or other terms in relation to the site or the Products or the Services (including any implied term relating to quality, fitness for a particular purpose) or any guaranteed or predicted result.
 

Subject to the important liability statement, Broadway Pilates is not liable for failure to comply
with these terms and conditions due to any event beyond its reasonable control, including,
without limitation, the input of incorrect information by you.

 

General

Broadway Pilates may change these terms and conditions from time to time.
By browsing the site you are accepting that you are bound by the current terms and conditions.
You should check these each time you revisit the site. These terms and conditions form the entire understanding of the parties and supersede all previous agreements, understandings
and representations relating to the subject matter.

 

These terms and conditions shall be governed by and interpreted in accordance with English law, and you consent to the non-exclusive jurisdiction of the English courts.

Monthly Passes

 

– Monthly 8
This membership comprises 8 classes at Broadway Pilates per month for a monthly fee of £132

If any additional classes are taken within the specified billing month, they will be charged to the card
on file at the rate of £16.5/session. All charges will be taken within 14 days of the previous billing period.

There is a minimum of 3 months commitment from the start date. It will automatically be renewed for subsequent months, unless cancelled by either the client or Broadway Pilates. A written cancellation
is required with a minimum of 31 days notice. Cancelling earlier then the commitment duration
will result in full payment of your commitment term.

Terms and Conditions:
● Classes can not be frozen or extended
● Membership applies to all standard classes
● Membership can not be shared
● Memberships can not be refunded
● Additional classes can be purchased at the rate of £16.5/session
● If you are seriously injured then an extension can be
provided given you have proof from a doctor

 

 

– Monthly 6
This membership comprises 6 classes at Broadway Pilates per month for a monthly fee of £102.

If any additional classes are taken within the specified billing month, they will be charged to the card
on file at the rate of £17/session. All charges will be taken within 14 days of the previous billing period.

There is a minimum of 3 months commitment from the start date. It will automatically be renewed for subsequent months, unless cancelled by either the client or Broadway Pilates. A written cancellation
is required with a minimum of 31 days notice. Cancelling earlier then the commitment duration
will result in full payment of your commitment term.

Terms and Conditions:
● Classes can not be frozen or extended
● Membership applies to all standard classes
● Membership can not be shared
● Memberships can not be refunded
● Additional classes can be purchased at the rate of £17/session
● If you are seriously injured then an extension can be
provided given you have proof from a doctor

 

 

– Monthly 4
This membership comprises 4 classes at Broadway Pilates per month for a monthly fee of £78

If any additional classes are taken within the specified billing month, they will be charged to the card
on file at the rate of £19.5/session. All charges will be taken within 14 days of the previous billing period.

There is a minimum of 3 months commitment from the start date. It will automatically be renewed for subsequent months, unless cancelled by either the client or Broadway Pilates. A written cancellation
is required with a minimum of 31 days notice. Cancelling earlier then the commitment duration
will result in full payment of your commitment term.

Terms and Conditions:
● Classes can not be frozen or extended
● Membership applies to all standard classes
● Membership can not be shared
● Memberships can not be refunded
● Additional classes can be purchased at the rate of £19.5/session
● If you are seriously injured then an extension can be
provided given you have proof from a doctor

– Monthly (Unlimited)

This membership comprises unlimited classes at Broadway Pilates per month for a payment of £199
 

The agreement runs for 3 months from the start date.

There is a minimum of 3 months commitment from the start date. It will automatically be renewed for subsequent months, unless cancelled by either the client or Broadway Pilates. A written cancellation is required with a minimum of 31 days notice. Cancelling earlier then the commitment duration will result in full payment of your commitment term.

● Classes can not be frozen or extended
● Membership applies to all standard classes
● Membership can not be shared
● Memberships can not be refunded

● If you are seriously injured then an extension can be
provided given you have proof from a doctor

Guest Pass

– Valid with the purchase of an ‘Introductory Offer (3 classes for £66)’
– No cash/credit alternative
– One Guest Pass per intro block
– Unclaimed Guest Passes expire after 14 days
– Claimed Guest Passes expire after 1 month
– Valid on all standard classes
